Recusación formulada en contra del magistrado Miguel Polo Rosero.
El demandante basó su recusación en el principio de imparcialidad judicial y en el hecho verificable de que, al momento de dictar el auto de inadmisión, no se había resuelto la manifestación de transparencia del magistrado, en la cual reconocía haber laborado como asesor legislativo durante el trámite del proyecto que dio origen a la ley objeto de control constitucional.
Al hacer el respectivo análisis concluyó la Sala Plena que la recusación impetrada en esta oportunidad es impertinente porque, si bien satisface los requisitos de legitimación en la causa por activa y de oportunidad, no cumple con el de carga de argumentación y, por eso, se RECHAZÓ.
